A fatal crash that killed a mother and sons puts ICE status on the suspect

A man accused of causing a fatal crash that killed a mother and her two young sons is now in ICE custody, as new information emerges about his background and criminal history.

Victor Napoleon Reyes, 33, faces three counts of reckless homicide in connection with Sunday night’s crash on Arch Street that left Breu’hna Hall, 31, and her two sons dead.

According to jail records, Reyes is being held at the Pulaski County Detention Center on a $350,000 bond and is subject to ICE arrest.

Reyes’ attorney, Bill James Jr., told Channel 7 News that he does not believe his client has legal standing in the United States.

“As for being in the country… I don’t believe you’re legal here, no,” James said.

James told the outlet that the ICE detainer may have been the result of Reyes’ arrest.

“If someone is in custody, and it’s believed to be illegal, a lot of times ICE will arrest them,” he said, adding that “you’re not going to get ICE unless you’re in custody.”

He also said that if Reyes posts bond, he can be turned over to federal authorities.

“If he makes an arrest, he’ll be released to ICE, and then it’s up to ICE whether they take him or not,” James told Channel 7 News.

Arkansas State Police say the crash happened around 9:15 p.m. Sunday on Arch Street near Dixon Road, when Reyes, driving a 2016 Chevrolet Silverado, crossed the center line and hit a Buick.

Inside the Buick were Hall and his two young sons – 4-year-old Dax Barnes and 2-year-old Dyce Love. Authorities confirmed that all three died from their injuries, and said that Reyes fled on foot, which led to a two-day search for him before he was arrested on Tuesday afternoon.

According to law enforcement records obtained by Channel 7 News, Reyes has a history of driving while impaired. In 2016, he pleaded guilty to first-degree DWI. In 2023, he pleaded guilty to second-degree DWI, and driving on a suspended license.

James told Channel 7 News that prior charges do not automatically mean Reyes was negligent in this case.

“Just because he’s done something in the past doesn’t automatically mean he was negligent in this case,” he said, adding that his client’s immigration status “makes it easier to charge those people,” though he acknowledged there appears to be causation.

Loved ones described Hall as a devoted mother and ‘joy to be there,’ who is now grieving alongside her two young sons. He left behind a 12-year-old daughter, whom family members say will continue to provide for her. A GoFundMe was created to help cover funeral expenses and help the family.

Reyes pleaded not guilty and is expected to return to court on July 1.
