The Colorado Supreme Court has ruled that the hospital must resume care of the children’s sex

The Colorado Supreme Court on Monday ruled that Children’s Hospital Colorado must resume its gender reassignment treatment for children.

Children’s Hospital Colorado – one of the top children’s hospitals in the nation – initially suspended treatments such as puberty blockers and hormone therapy for patients under the age of 18 after the US Department of Health and Human Services (HHS) issued an announcement in December warning that federal Medicaid funding for hospitals may be restricted from providing these treatments.

Four transgender patients, through their parents, sued the hospital, claiming that terminating the treatment violated federal anti-discrimination law. In particular, they argued that the hospital was discriminating against patients based on gender by not providing these treatments that were available to some children.

In a 5-2 decision, the court ruled in favor of the patients, finding that the hospital not only violated anti-discrimination laws but also risked “irreparable harm” to patients by denying them medication.

“We conclude that the actual immediate and irreparable harm to petitioners outweighs the perceived harm that CHC may suffer if the federal government proceeds against it,” Justice William Hood III wrote in the majority opinion.

In a comment to Fox News Digital, Children’s Hospital Colorado said, “Children’s Hospital Colorado is reviewing the court’s decision and evaluating our next steps. While we have no updates to share at this time, we will provide guidance in the near future.”

Fox News Digital has also reached out to HHS for comment.

Colorado was one of 19 states that initially filed a lawsuit against the Trump administration and HHS Secretary Robert F. Kennedy, Jr. with his proposal, saying it was illegal and an attempt to exceed established medical standards without public notice or comment.

In March, US District Judge Mustafa Kasubhai of Oregon, a Biden-appointed judge, ruled that Kennedy exceeded his authority and failed to follow required administrative procedures when HHS initially issued the order. This provided first aid to healthcare professionals providing treatment and prevented HHS from enforcing the declaration at this time.

Kennedy and the Trump administration have been trying to deny medical treatment to transgender children since the start of President Donald Trump’s second term.

“On my watch, HHS will stand for greater transparency and informed consent,” Kennedy said in December. “We follow the evidence. We use gold standard science. We respect the moral obligation to do no harm. There is a divine value in every human being. It shines brightly on our children who we are being told to protect.”
