DHS asks Gov. Spanberger not to release the suspect who was raped illegally

FIRST ON FOX: Virginia Democratic Gov. Abigail Spanberger is being asked not to release yet another illegal immigrant criminal as Northern Virginia, the capital of Washington, DC, continues to be rocked by immigration crime.

Fox News Digital has learned that the Department of Homeland Security has asked Spanberger and “sanctuary politicians” in Arlington, Virginia, to honor a US Immigration and Customs Enforcement detainer for an illegal immigrant from Guatemala who is charged with attempted rape.

The illegal immigrant, Luzvin Orvando Garcia Moran, 28, faces charges of abduction with intent to defile, sexual intercourse with a child by force or helplessness, and assault with intent to rape, according to DHS.

Local outlet ABC7 reported that Garcia Moran allegedly approached a woman waiting at the boarding area around 6 a.m. Sunday and tried to force himself on her. He tried to escape many times but was caught, pushed against the wall, and beaten. The newspaper reported that two good Samaritans intervened to stop the incident, but the robber escaped.

Garcia Moran was arrested in connection with the assault and is being held without bond.

Since Arlington has several local policies that limit local cooperation with ICE, DHS said the agency has filed an inmate petition with the Arlington County Jail to ensure Garcia Moran is not released back into the community.

DHS said Garcia Moran entered the US illegally on an unknown date. Citing Arlington County Court records, the agency said it has “at least” 25 prior convictions since 2020, including nine counts of public intoxication, assault and battery, disorderly conduct, attempted robbery of a law enforcement officer and multiple violations.

This comes as Spanberger faces growing pressure from ICE and local residents to reverse his executive order limiting cooperation with immigration authorities in the wake of a spate of assaults and sexual assaults in nearby Fairfax County.

Recent illegal immigration crimes in Fairfax County include multiple stabbings, the murder of a child and the groping of an 18-year-old high school girl. Illegal aliens have committed 75 percent of the homicides in Fairfax County so far in 2026, according to the DHS.

Acting Assistant Secretary Lauren Bis charged that it was “Virginia’s sanctuary policies [that] allowed this illegal alien to commit a crime.”

“Even though the law enforcement officers have been arrested before, this criminal was released from prison many times before he continued to commit this heinous crime,” said Bis. “We are asking local Arlington County politicians and Governor Abigail Spanberger to commit to not releasing this criminal from prison and back into our communities.”

He asked, “How many times do they have to release criminals in our area to create innocent victims?”

Fox News Digital has reached out to Spanberger and Arlington County’s office for comment.
