Arby’s customer’s sandwich requests came with a nasty surprise with lasting results

An Oklahoma Arby’s manager is facing a food poisoning charge after police say surveillance video shows him allegedly spitting on a customer’s food, and a lawsuit filed by the same customer claims the incident led to herpes.

Amanda Hendricks, a former manager at an Arby’s restaurant in Broken Bow, Oklahoma, has been charged with poisoning with intent to injure following an investigation into a March incident involving customer Jennica Church, according to court records cited by local stores.

“I love Arby’s – I don’t anymore,” Jennica Church told KJRH.

According to an affidavit cited by local outlets, Broken Bow police obtained video from the restaurant and concluded that Hendricks spat out sandwiches prepared for Sunday. The lawsuit filed Sunday alleges that Hendricks was suffering from a herpes outbreak at the time and that Church tested positive for HSV-1 after eating the food.

Church told KJRH she stopped by the restaurant after a late bartending shift in March and noticed her order was taking longer than expected.

“It was taking a little while,” Church told the station. “I thought I was upset because it was about to be closed.”

According to KJRH, Church said he has a little history with Hendricks but nothing significant.

On the night of the alleged incident, Church said she ate one sandwich when she left the Arby’s parking lot and brought the leftovers home, which she shared with her husband and a relative who was receiving care at the hospital.

According to the lawsuit, Sunday later developed a mouth sore and eventually tested positive for HSV-1.

Local police began an investigation into the incident after receiving information from another Arby’s employee who alleged that a colleague had spit out a customer’s order, according to court records cited by local media.

Investigators obtained surveillance video from the restaurant and concluded it showed Hendricks slurping food being prepared for Church, according to an affidavit cited by KJRH and KXII. Police said surveillance appeared to show Hendricks put his head down near the ingredients of the sandwich before saliva landed on the food.

Hendricks was then charged with poisoning with intent to injure. He was booked into the McCurtain County Jail, according to Oklahoma outlet KXII.

Church’s lawsuit alleges Hendricks intentionally worked while dealing with a herpes outbreak and claims employees at Arby’s restaurants allowed him to continue working despite having visible symptoms.

Arby’s did not immediately respond to Fox News Digital’s request for comment.
