Fairfax prosecutor Descano received a 5-year plea deal for two murder suspects

The two convicted killers — including one who is an illegal immigrant — will serve just five years in prison each under a plea deal with Virginia prosecutors.

Maldin Anibal Guzman and Wis Alonso Sorto-Portillo pleaded guilty to the 2024 mob murder of Nicacio Hernandez Gonzalez, who was found dead of blunt force trauma in Fairfax County, according to police.

Both men pleaded guilty to mass murder and were sentenced to 25 years in prison, with 20 years suspended, with five years left to serve, Fox News said. The judge accepted the plea agreements.

Fairfax County Commonwealth’s Attorney Steve Descano secured a guilty plea, reducing potential sentences of decades in a case his office said lacked significant evidence.

Descano’s office defended the deal, telling Fox News that the deal was “the only way to ensure that the defendants are arrested.”

“There was no DNA and physical evidence at the scene. All the witnesses in this case were afraid to come forward or help the prosecution,” said the office.

Immigration and Customs Enforcement confirmed that Guzman is an illegal Honduran national who entered the US illegally in 2018 and was ordered removed by an immigration judge in 2019.

ICE said it filed multiple arrests against Guzman between 2022 and 2023, but the Fairfax County Adult Detention Center refused to honor them and released him from custody.

The agency also said Guzman had prior convictions, including burglary and assault, before his arrest in the 2024 murder.

ICE said it had no record of dealings with Sorto-Portillo.

Hernandez Gonzalez was found dead in a wooded area in the 9500 block of Route 29 in Oakton shortly after 3 p.m. on July 20, 2024, according to Fairfax County police.

Detectives arrested Guzman, 27, and Sorto-Portillo, 45, both of whom were listed as having no fixed address, and initially charged them with criminal damage by mob. A third suspect, Wilmer Adli Guzman, 20, was later arrested in Washington, DC, police said.

Descano’s office has pursued a reform agenda since taking office in 2020, including ending cash bail requests and implementing sentencing policies aimed at reducing incarceration, according to his office’s website.

The case comes as Fairfax County has seen more homicides involving illegal immigrants this year, according to a report cited by state officials.

The Department of Homeland Security highlighted the practice on social media, urging Virginia leaders to change policies they say allow illegal immigrants suspected of violent crimes to live in communities.

The problem of illegal immigration has not abated: of the four homicides this year, three are suspected of being committed by illegal immigrants, according to DHS.

“Governor Spanberger must end his local policies that allow these illegal immigrants to enter our streets,” the organization wrote.
